PLUGIN & THEME LICENSING
Q: Are any plugins that cost money a one time purchase and good forever? A: Cost for plugins is plugin dependent, but… Here’s the short answer…
Licenses
Licenses for commercial themes and plugins are extended to the customer upon delivery of built website or Subscription use of website with some limitations as defined below.
- If we BUILD your site then there is no cost for commercial plugins or themes that we use to build your website. Any commercial plugin or theme we use to build your site is included FREE, but no ongoing support or upgrades are provided.
- Ongoing support and upgrades for commercial plugins and themes are only available if you have a current Managed WordPress Services subscription with us.
- If we HOST your site (active Managed WordPress Hosting subscription) then there is no cost to use available plugins/themes on your SiteSubscribe hosted website, you have access to our full library of commercial plugins and themes all FREE.
- Many commercial plugins and themes are also available with some of our Managed WordPress Services where we aren’t hosting your website but allow you to host your site elsewhere and we just provide Maintenance + Support.
- Support and upgrades for plugins and themes are included free as long as your Managed WordPress Services account is current.
In all cases we own the license to the plugins & themes and extend that license to you (with some limitations), so to get support you must go through us, not through the plugin/theme developer (unless you can find a free online forum).
Here’s the long answer… In many cases we own the ‘Developer’ license which generally grants unlimited use (for us and our clients). In some cases the license is ‘per site‘ (rather than ‘Developer’) in which case we pay for each site/domain the plugin is used on.
Some plugins have a recurring annual fee for support and upgrades from the developer. All of that is behind the scenes since we take care of the ongoing plugin and theme costs which are already included in our site building and Managed WordPress Services pricing (for site building the upgrades and support are covered up until the point we deliver the website).
In some cases, for some commercial plugins we need to buy a license for each website using the plugin…so please advise us of which commercial plugins you want to use.
Once you we deliver your site and you have paid in full for all web development, you own your site and are free to do what you want with your site, and your site services such as hosting, maintenance, support, etc.
As time moves on it becomes very important to maintain your website by keeping everything up-to-date…keeping WordPress core, and all plugins & themes continually updated to the latest versions to make sure your website has all of the latest security patches and to make sure your website continues to function the way it is supposed to (especially after a WordPress core update).

The nature of commercial plugins & themes is that they cost money…at least some one time upfront cost and also in many cases ongoing costs for support and upgrades (depending on the license).
Once your site is built and delivered, if you don’t take advantage of our Managed WordPress Services (by opting to just go with a normal web host, i.e. other than us)… you won’t get continued ongoing ‘upgrades & support’ from plugin & theme developers for commercial plugins and themes that were included when building your site.
Since all commercial plugins & themes are licensed and registered to us in our name, all support and upgrades for commercial plugins & themes is done through us.
You can still get technical support or other web design services for your website elsewhere, but if you have our Managed WordPress Services then commercial plugin & theme licensing and support is carried over to your website, but still through us (any plugin support where the plugin developer needs to be contacted is done by us); and then your website is serviced by us for support & upgrades (either through one of our monthly Managed WordPress Services or through a one-off support instance).
That’s generally the way ‘developer’ licensing works for folks who build websites for clients (support is given to the registered license holder, which is often the Web Designer/Developer and not necessarily carried to the website owner). We just happen to be one of the very very few services that offers continued service and support, which is why we’ve established these rules within our Terms of Service so that our customers know what their options are over time.
Most other web developers and web designers deliver your website and send you on your way to your web host, and typically don’t provide ongoing support & upgrades, and especially most don’t usually offer continued licensing support for continuous plugin and theme upgrades. Most web developers usually just let plugin and theme licenses expire, letting your website get really stale (and more importantly insecure) with much needed upgrades that aren’t attended to, and many of you in that situation end up calling us for ongoing upgrades & support.
Our Managed WordPress Service allows continued ongoing ‘upgrades & support’ for all necessary plugins & themes all for the low cost of Managed WordPress Service, and it is all included along with hosting, maintaining, and supporting your site since we have purchased and registered/own all of the necessary licenses. We believe our service makes the overall cost of operating your website lower overall, while also keeping your website in top condition over the long haul. We reserve the right to limit access to plugins/themes at any time at our discretion.
Are There Other Costs?
Q: Does your ecommerce allow for PayPal Standard as opposed to PayPal Pro, which has a monthly service charge?
A: Sure. We actually recommend PayPal Standard in most cases since it is the free version of Paypal (no monthly cost, only per transaction cost)
Q: What are any monthly/yearly recurring fees for the shopping cart/website/plugins/extensions besides the hosting cost?
A: Zero. If you went with Paypal Pro then you’d incur annual SSL certificate cost, but you probably don’t need to go that route. Of course you have your annual domain renewal with your domain registrar.
PLUGINS, FEATURES, AND WEBSITE FUNCTIONALITY
Various plugins and themes are offered with each plan to extend the functionality available to your website and to the back-end administration. Plugins and themes are made by many different 3rd parties, and are constantly undergoing upgrading and revisions.
Not all website functionality can be used together. Sometimes plugins (or themes) that once worked fine may become unusable or cause a conflict with other plugins due to the ever-changing environment of the WordPress platform, plugin upgrades, themes, other plugins, servers, browsers, operating systems, etc.
Certain plugins or themes can also be found to tax web servers or browsers with excessive processes that cause web pages to load too slowly, or servers to become overloaded. We will make every attempt to only offer plugins and themes that are practical enough to use in their implementation within this platform without degrading service to other members, and to keep plugins and themes that are offered with each plan up-to-date and tested for compatibility.
Due to the evolving nature of plugins, themes, and the WordPress platform we offer no guarantee that any particular plugin, theme, or feature will remain available or offered for any particular Managed WordPress Hosting Plans or Website Design Package, or that any plugin, theme, or feature will continue to work without conflict of other features (typically themes, once installed will not cause problems since they do not upgrade frequently like plugins do so this applies primarily to plugins).
There are thousands of plugins for WordPress. As we discover new or better plugins, or as customers request specific plugins or functionality, we may choose to test and add plugins. In some cases functionality of a new plugin may duplicate or affect existing functionality. From time-to-time, in order to provide the best overall experience for all of our members, and in some cases to reduce redundancy of functionality, we may deem it necessary to de-activate or even delete/remove certain plugins or features.
We welcome suggestions for including additional themes or plugins and we will make every effort to include customer suggestions, but we are not obligated to install additional themes or plugins suggested by customers. We are happy to add/install any qualified plugin or theme at any time at NO COST to our customers.
We reserve the right to determine at our own discretion which plugins, themes, or features to support at any time. In the event we deem it necessary to remove a plugin, theme, or feature or alter functionality we will try to verify in advance if any customers are affected by the change and then notify them specifically, and then post a general admin message within the dashboard as notification of the change.
We will always make our best effort to avoid, or if the case may be, to overcome any plugin or theme conflicts. We recommend customers save a backup of their website before activating any new plugins. In addition we recommend customers save a daily backup of their website since we may upgrade existing plugins at any time (typically several times per week).
SUPPORT POLICY
Support is provided on a first come first served basis with the exception of instance based Premium Support. Higher level Web Plans are serviced with higher priority than lower level Web Plans.
We have not had any instances where we could not support a customer, but we need to mention that the amount of time we will dedicate to supporting any particular customer is limited to what is defined on our Managed WordPress Services page, and at most to what is reasonable (generally in the ballpark of up to about 2 hours per client per month maximum).
Support is not unlimited, and depends upon the Managed WordPress Service plan. We reserve the right to limit support to a reasonable amount of time or number of issues per month, or to charge a premium for additional support needed (with customer approval). If we do not recceive customer approval for additional required support than we reserve the right to not support that customer’s website.
Though we will make every effort to resolve all issues, we cannot guarantee that we can resolve every possible issue.
ACCEPTABLE USE POLICY
Our Acceptable Use Policy is an integral part of our Terms Of Service and must be fully agreed upon as part of our Terms Of Service.
This Acceptable Use Policy, including the following list of Prohibited Activities, along with our Terms of Service, are an integral part of your Hosting Agreement with SiteSubscribe. The Customer may only use SiteSubscribe’s services for lawful purposes. If you engage in any of the activities prohibited by this AUP document or any unlawful activities, SiteSubscribe has the right to immediately discontinue such service to Customer without liability.
SiteSubscribe’s Acceptable Use Policy (the “Policy”) for SiteSubscribe services is designed to help protect SiteSubscribe, SiteSubscribe’s customers and the Internet community in general from irresponsible or, in some cases, illegal activities. The Policy is a non-exclusive list of the actions prohibited by SiteSubscribe. SiteSubscribe reserves the right to modify the Policy at any time.
References to SiteSubscribe’s servers also include any services provided by any of our 3rd party vendors.
Forbidden Content
We do not allow sites involving the following types of content:
- Adult content.
- Horoscopes.
- Gay/Transgender lifestyles.
- Obscene or objectionable material
- Unlicensed proprietary content.
- Any product that, in SiteSubscribe’s sole judgment, encourages the unlawful transfer of copyrighted media, such as music, movies, videos, and games.
- Spyware.
- Existing debts or promissory notes.
- Digital cash.
- Spending accounts.
- Money transfer.
- Gift certificates.
- Securities or stocks or bonds.
- Deeds or titles.
- Lottery tickets or sweepstakes.
- Wagers or wagering pools, gambling or betting of any kind.
- Pornography or pornographic entertainment of any kind.
- Warez.
- Pirated software or pirating tools.
- Hacking tools.
- http/tcp proxies, irc/ircd, Bnc, Eggdrop, Socks4/5.
- Remote bots.
- Shell accounts.
- Dial-ups or dial-ins.
- Phone services, phone minutes, cell messaging, or cell sms.
- Spamming tools.
- Fake ID tools.
- Credit reports or credit repair.
- Social security number (“SSN”) searches, SSN lookups, or SSN verifications.
- Anonymous proxies or proxy lists.
- Password lists or email address lists or postal address lists.
- Multilevel membership (including MLM, matrix, wheel, cylinder, downline, upline, chain, or pyramid) or any Product that has no appreciable value to the customer other than the potential for resale.
- Products about marketing through Craigslist or social networking sites that are contrary to the social networking site’s terms of use.
- Any materials containing, endorsing or encouraging discrimination, violence, hatred, revenge, racism, victimization, criminal activity.
- Any other category SiteSubscribe decides to prohibit.
- Sending Unsolicited Bulk Email (“UBE”, “spam”). The sending of any form of Unsolicited Bulk Email through SiteSubscribe’s servers is prohibited. Likewise, the sending of UBE from another service provider advertising a website, email address or utilizing any resource hosted on SiteSubscribe’s servers, is prohibited. SiteSubscribe accounts or services may not be used to solicit customers from, or collect replies to, messages sent from another Internet Service Provider where those messages violate this Policy or that of the other provider.
- Unsolicited advertising via email and/or “Spamming” is a violation of State and Federal Law and is otherwise a violation of this agreement. This includes referencing domains hosted on SiteSubscribe servers in said spam. Such prohibited conduct subjects Customer to immediate cessation of service as provided herein and the termination of this agreement without notice. SiteSubscribe reserves the right to report such illegal activities to any and all regulatory, administrative and/or governmental authorities for appropriate prosecution. In addition, SiteSubscribe has the right to charge one dollar (US$1.00) per email recipient for any such activity.
- Mass mailings, scripts that send out mass mailings or any other kind of high-volume mailing activities are not allowed on our servers. Purchasing lists of email addresses from 3rd parties for mailing to from any SiteSubscribe-hosted domain, or referencing any SiteSubscribe account, is prohibited.
- Using a non-existing email return address on a commercial solicitation, spamming (sending unsolicited advertising to numerous email addresses or newsgroups and/or generating a significantly higher volume of outgoing email than a normal user), trolling (posting outrageous messages to generate numerous responses, mailbombing (sending multiple messages without significant new content to the same user), subscribing someone else to a mailing list without that person’s permission or attempting without authorization to enter into a secured computer system. SiteSubscribe reserves the right to determine what is internet abuse.
- Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, which includes, but is not limited to, the facilitation of the means to send Unsolicited Bulk Email, initiation of pinging, flooding, mail-bombing, denial of service attacks.
- Operating an account on behalf of, or in connection with, or reselling any service to, persons or firms listed in the Spamhaus Register of Known Spam Operations (ROKSO) database at www.spamhaus.org.
- We do not host adult (porn) websites or any websites that contain nude photos or video. We do not host websites focused on horoscopes or gay/transgender lifestyles. The Customer expressly understands and agrees that SiteSubscribe is not liable for legal action taken against Customer websites that have content featuring nudity and/or of a sexual nature. If you are not sure if you website falls into the “adult” category, then enter a support ticket through our Help Desk or through our Contact web form, referencing the url or the purpose of your website and we’ll let you know if it is the type of website that we will host.
- We do not allow the unauthorized distribution or copying copyrighted software and files (including MP3’s, warez, cracks, ROMs, etc.), violation of US laws, harassment, fraud, trafficking in obscene material, drug dealing (including so-called ‘medical marijuana’, whether deemed legal in your state or not), and other illegal activities. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. SiteSubscribe reserves the right to report such illegal activities to any and all regulatory, administrative and/or governmental authorities for appropriate prosecution.
- In general, we do not host any kind of media download websites, that is websites that exist specifically to enable people to download files, audio, video (mp3’s, ROMs, emulators, video games, cheats etc.). We do allow image downloads for photography based websites.
- Unauthorized attempts by a user to gain access to any account or computer resource not belonging to that user (e.g., “cracking”).
- Obtaining or attempting to obtain service by any means or device with intent to avoid payment.
- Unauthorized access, alteration, destruction, or any attempt thereof, of any information of any SiteSubscribe customers or end-users by any means or device.
- Knowingly engage in any activities designed to harass, or that will cause a denial-of-service (e.g., synchronized number sequence attacks) to any other user whether on the SiteSubscribe network or on another provider’s network.
- Using SiteSubscribe’s Services to interfere with the use of the SiteSubscribe network or servers by other customers or authorized users.
- Tortious conduct such as posting of defamatory, libelous, slanderous, scandalous, or private information about a person without their consent, intentionally inflicting emotional distress, or violating trademarks, copyright, or other intellectual property right.
- Any other misuses of the system resources, such as employing scripts or programs which consume excessive CPU time or storage space, permitting use of mailservers, mail forwarding capabilities, POP accounts, file managers, autoresponders or resale/outsource of access to scripts installed on our servers (plugins that involve these functions are permissible on a case-by-case basis).
- Attempting without authorization to enter into a secured computer system. Malicious hacking, cracking or otherwise altering of a website owned and operated by another person. SiteSubscribe reserves the right to report such illegal activities to any and all regulatory, administrative and/or governmental authorities for appropriate prosecution.
- Script sharing with other domains is not permitted. Any scripts deemed to be adversely affecting server performance or network integrity will be shut down without prior notice.
- IRC software, IRC bots or Eggdrop bots are not allowed on our servers.
- Customer installed chat room scripts or programs are not allowed on our servers (plugins that involve these functions are permissible on a case-by-case basis).
- We do not allow web cams because they could potentially reduce our servers’ performance as well as consuming large amounts of bandwidth.
- Shell emulators, virtual servers, file systems or system binaries are not allowed on our servers.
- We do not allow websites that provide banner ad services outside websites (subject to approval on case-by-case basis). Using banner ads on your own website is fine.
- Dating or personals scripts and other scripts that send out anonymous email are not allowed on our servers.
High Risk Businesses
Any business pertaining to firearms (Guns, knives, stun guns, pepper spray, etc), gambling/casino/betting content, travel services, matchmaking/dating/escort, replica merchandise, vitamins/nutritional supplements, online rare coins, tobacco/cigar, credit repair, “get rich quick” strategies, 1-800-type chat sites, investment / financial recommendations or advice or debt collections will be automatically declined. IF YOUR BUSINESS FALLS INTO ONE OF THESE CATEGORIES, PLEASE CONTACT US FOR A SITE REVIEW (subject to approval on case-by-case basis since these types of sites require special handling).
Customer Responsibility for Customer’s Users
In the case of any customer installed scripts, customers are responsible to ensure the security of scripts uploaded and used on our servers. This includes maintaining all scripts and code installed by customers on our servers by keeping them updated to their current stable version.
Each SiteSubscribe customer is responsible for the activities of its users and, by accepting service from SiteSubscribe, is agreeing to ensure that its customers, representatives or end-users abide by this Policy. Complaints about customers, representatives or end-users of an SiteSubscribe customer will be forwarded to the SiteSubscribe customer’s primary contact for action. If violations of the SiteSubscribe Acceptable Use Policy occur, SiteSubscribe reserves the right to terminate services with or take action to stop the offending customer from violating SiteSubscribe’s AUP as SiteSubscribe deems appropriate, without notice.
USE CONSTITUTES AGREEMENT
By using this website (also referred to as “site” or “Site”) or any of other websites owned by or affiliated with our company you signify your knowledge of and agreement to all terms set forth in these Terms and Conditions, our Privacy Policy, and our Acceptable Use Policy which together combine as our ‘Policies’ and constitute the “Agreement”.
If you do not agree to the terms of the Agreement, please do not use this website or our services. We (also referred to as “us”, “our”) reserves the right, at our discretion, at any time and without prior notice to change the Agreement or any part of it.
Please check the Agreement regularly when you enter the Site for any changes to this Agreement. The changes to the Agreement shall be effective immediately upon our posting a revised Agreement on the Site. Your use of the Site following the posting of any revised Agreement constitutes your agreement to be bound by those changes.
CONTENT UPDATES & SITE ENHANCEMENTS
Once your website is built our Managed WordPress Hosting Plans do NOT include any free website updates of customer content changes, layout changes, or site enhancements without a Website Customization service charge for our time.
Please contact us for any site changes or updates and we’ll be happy to make them for you for a nominal charge.
CONTENT OWNERSHIP
Our Content
All materials contained within this website (also referred to as “site” or “Site”) including, but not limited to, all images, text, software, illustrations, designs, logos, icons, video and audio content, scripts, and other materials and items on the Site, as well as the Site as a whole (collectively the “Content,” which does not include any Member Content, discussed below), are owned, controlled and/or licensed by us.
The Content is protected by trademark, trade dress, copyright, and/or other intellectual property rights of our company or third-party licensors against any unauthorized uses not expressly permitted by this Agreement. All worldwide rights, title and interest in and to the Content are owned by us or third-party licensors. This Site and Content are copyrighted under Creative Commons attribution license. All rights not expressly granted herein are reserved.
Member Content
We do not claim any ownership rights to the text, files, images, photos, graphics, sound, video, works of authorship or any other materials that site Members or visitors post on their websites managed by us, their member profile page, in forums, reviews, chatrooms, comments, or elsewhere on the Site (individually and collectively, “Member Content”).
By posting your Member Content to the Site (or having us add content to your website), you warrant that you are the express copyright holder of such content, and that SiteSubscribe shall be held blameless for copyright infringement. You shall retain all ownership rights in your Member Content.
By posting, submitting or otherwise exchanging Member Content on or through the Site, you acknowledge, agree and understand that, while we will make every effort to protect Member Content that is intended for certain members only or that is intended as ‘private’ (based on password protecting pages or ‘membership only’ pages), (i) Member Content that is posted within public website areas will not be considered or treated as confidential, (ii) others may see, read, use or re-transmit your Member Content, (iii) you explicitly represent and warrant that you are the sole owner of such Member Content or have all rights and licenses necessary regarding such Member Content and the grant of the License granted in the following paragraph iv, and (iv) that we and the other members of the Site are thereby granted a royalty-free, perpetual, irrevocable, unrestricted, world-wide, nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, adapt, transform, distribute, transmit, broadcast, perform and display such Member Content in any media or medium, or any form, format, or forum now known or hereafter developed for no compensation whatsoever (the “License”).
This License includes a grant to us and the Site and all other persons or entities involved in the operation of the Site of the right to transmit, monitor, retrieve, store, and use your Member Content. We may sublicense its rights through multiple tiers of sub-licenses. You may remove your Member Content from the Site, or terminate your membership with us, but such removal or termination does not terminate the License to the extent that such Member Content may still be located on this site or other members’ computers, or located in other places not readily viewable on the current Site but accessible through archived files or bookmarked or undeleted text. Neither we nor the Site assumes any responsibility or liability for any Member Content you provide, or any third parties’ use or misuse of your Member Content.
Customer Testimonials & Screenshots
We reserve the right to use screenshots of any website we build or host for promotional purposes for an indefinite period. We also reserve the right to include within our customer testimonials section or other online locations for an indefinite period any positive statements about our work derived from customer communications such as emails.
OUR BACKUP POLICY
We will backup all customer sites periodically (typically daily) including customer files and database. Even though we create periodic backups we ask that customers ensure that they have backups of their own configured to suit their own backup needs since, based on the customer Website Plan, our backups may contain other custom data not suitable for each individual customer.
We are not responsible for loss of data, regardless of the time frame involved.
BACKUP: TAKE YOUR DATA WITH YOU
Members can download a database file backup of their web files from within the Admin Dashboard at any time via a plugin that offers backup functionality (in fact it is recommended to backup your data periodically so that you always have a relatively recent backup available). There are also plugins that support offsite backup to other ‘cloud-based’ services such as Amazon S3 (we can help you with getting backups configured).
If you decide to cancel your subscription you can take your data with you, but please be sure to backup your data to your local computer or to an offsite location BEFORE canceling your subscription.
Data that is typically available for download within a zipped WordPress database file includes post and page content, links, and WordPress configuration data (including plugin configuration settings). This file is most useful if you wanted to start another WordPress website and needed to import your data.
We suggest you also keep a copy of content within a local file on your computer when uploading to a page or post. In rare cases some themes and/or plugins may not be included in the database download performed by WordPress.
RESTORING DATA
We reserve the right to charge an Addon Services fee for restoring customer data to a prior state (a.k.a. data ‘rollback’). We cannot guarantee that the data restored will be to the exact state desired by the customer since backups are pre-set at certain periodic intervals, and are also subject to file corruption.
DATA RETENTION
Data Retention for Customers or Former Customers In Good Standing
For customers or former customers in good standing at time of service cancelation any customer data will be retained on file for a Data Retention Period of 90 days.
Data Retention for Customers or Former Customers In Payment Default
For customers or former customers NOT in good standing at time of service cancelation any customer data will be retained on file for a Data Retention Period of 3 days.
Data Retention Period Expiration
After which time the Data Retention Period expires we reserve the right to discard any customer information, data, or files without further notice.
WEBSITE BUILDING DELIVERABLES
Requirements
If we are building a website for you we will coordinate closely with you on your requirements (how you want your site to look and what you want it to do).
Scheduling
Websites usually take anywhere from 2-6 weeks once we receive everything we need from you before we present a ‘proof’ to you to view. Timing on getting your website up and running ‘live’ (from beginning to end) depends on a lot of things, including:
- Accepting the Estimate so we have agreement on the scope of work and price so we can proceed.
- Getting all the requirements (list of required functionality, a.k.a. ‘scope of work’) from you.
- Getting ALL assets for the site (images, content, product info, login credentials, Paypal email, etc.) from you.
- Getting the deposit on your project so we can schedule in the work.
- Getting the site scheduled to build (scheduling your project in along with our other work based on current capacity and work load).
- Building the site (typically 2-6 weeks for this part).
- Making any reasonable edits to original proof (typically within 1 week).
- Getting the site approved (customer ‘sign-off’ on project).
- Migrating your site to your web host if we are not hosting your site (typically 1-4 days).
Progress/Status
Proofs
Proof delivery dates are approximate (‘soft dates’). At your request the proofing stage can be password protected for private viewing only until the site is approved to go ‘live’, keeping the proof unavailable for public viewing. We typically provide your proof from our ‘development site’, which may or may not reflect your actual domain name. This is typically how we do things.
Change Requests
We allow reasonable changes to the initial website proof at no additional cost. We will notify the customer in advance of any feature requests, change requests, or content changes that would go over the initial quoted price or that would constitute additional services.
Final Deliverables
We will make every effort to keep to any planned schedules, but website delivery dates are approximate (‘soft dates’). Web Building deliverables include all website data within a zipped file including all theme files, plugin files, media files, WordPress database file including post and page content, links, and WordPress configuration data (including plugin configuration settings).
SUBSCRIPTION DELIVERABLES
Upon payment confirmation subscription clients will be given full service access with email notification containing account information (username, password, plan selection, and a hyperlink to the Admin Dashboard) (in most cases we may send your login credentials only after we have a ‘design proof’ of your website to show you).
Subscription customers will also have immediate access to all services available within their subscription plan such as Training and Technical Support that may apply to the features within their chosen Managed WordPress Service.
SERVICE LEVEL AGREEMENT (SLA)
Due to the evolving nature of plugins, themes, and the WordPress platform we offer no guarantee for website up-time, service suitability for purpose, or site functionality (including backend administration). We will, however make every effort to ensure that websites are functional as expected. This is our business and we have been successful in retaining customers with our level of service.
As far as web hosting and email service are concerned we use 3rd party servers, and therefore our client websites are subject to their Service Level Agreements. Currently we use Hostgator for hosting all websites. Hostgator boasts 99.9% uptime and offers great technical support! Their SLA can be found here. Even though Hostgator provides their own SLA, we are providing another valuable layer of service on top of theirs which carries an additional layer of potential service interruptions (i.e. there are times when we need to reboot our Hostgator servers virtually, which can cause a few minutes of occasional downtime).
SECURITY
All purchases are transacted using a PCI Compliant secure payment gateway. All credit card data is transmitted via a 3rd party payment gateway using their servers and a secure (encrypted) HTTPS protocol according to current SSL standards.
When you purchase our services the payment gateway provider sends us a confirmation message with customer details, but does NOT provide us with any payment information. We never receive or collect ANY credit card information. All customer files and data (other than credit card info) are stored on our web host provider’s servers. Their security policy can be found here.
In addition to security measures implemented by our web host provider, we also incorporate several security patches and other security measures that are continuously updated in order to protect customer data from online hackers. Additional levels of security are available as security plan Addon Services. If a customer’s website poses a risk in any way to other websites or our hosting platform we reserve the right to disable/remove the offending website.
DOMAIN NAMES
If we register a domain for you then we will register it for 1 year. Between 30 to 60 days prior to the date the annual renewal is due your account will be charged for 1 year domain renewal. If we are unable to collect payment then we will attempt to get updated payment information from you. If we are still unable to receive payment then your domain will expire and it is possible that someone else may obtain it on the open market.
To transfer an existing Domain Name that you have currently registered with someone else, simply use the ‘Buy Now’ button found here on our Domain Registration page and we will request a transfer from your current domain registrar to us. We will extend your domain registration for 1 year. The additional registration year will be added to any time left on your current domain registration.
Should I renew or transfer my domain? If so, when?
Your existing domain can be redirected to our servers (by pointing the DNS) at any time regardless of when your domain registration expires. That is as long as either you renew your domain when it is due with your existing domain registrar, or if you want to transfer the domain to us (rather than repointing the DNS) than your domain needs to be transferred at least 2 weeks before it is due for renewal or expiration. See PROPAGATION section.
Propagation of Changes to Records & Pointers
When making changes to domain or web host settings such as Name Servers, DNS Records, and MX Records (email), these changes take time to ‘propagate’ throughout the internet so that the changes can be fully ‘resolved’.
Being ‘resolved’ means that the records and pointers have taken effect throughout the internet so that you can see the updates have taken place. Until propagation takes place and your domain has resolved your website will likely experience down time.
Example of Propagation
An example of propagation is when you change your web host and have to update your DNS records to point to a different sever. Such changes can take hours or even days to resolve, meaning that during the propagation time your website will be down.
In many cases email service is also affected. The time for propagation depends on a lot of factors, including your location (the location of your ISP’s server relative to others around the world).
Caching
Other factors may involve caching of web pages and DNS settings. Because web pages and settings may be cached, therefore not taking into account the updated settings, it’s a good idea to clear your browsers cache, and to use a service like PageWash.com to check your website to see if the changes have resolved.
General Propagation Time Required
- Domain Transfers: 2 hours – 12 days (our experience is that it typically ends up taking between 4 to 6 days).
- Name Servers: 4 hours – 8 days.
- DNS Records: 4 hours – 8 days.
- MX Records (email server): 24 – 72 hours.
Please take these time elements into consideration when planning changes.
Transfers or changes from one server to another within the same hosting company often reduces propagation time.
HOSTING STORAGE SPACE
Managed WordPress Hosting Plans include a set amount of storage space with each hosting plan (for all web content including html, images, video, SQL database, etc.). See our Managed WordPress Hosting Plans for details on storage allotments.
Additional storage is available as an Add-on Service.
Bandwidth
We don’t really limit bandwidth unless there becomes a problem with server performance. We are allocated a certain amount of bandwidth from our host provider, and we generally pass that onto our customers without restriction. In such a case we will manage bandwidth only to the extent of maintaining the health or our server.

In order to facilitate collecting content from our customers in an efficient manner we use a shared ‘collaboration folder’ from a service called “DropBox“. The Dropbox folder and all files within it are temporary in nature, meaning that they could go away at any time if we (or another folder member) should choose to delete it.
Keep in mind that this is not permanent storage, so we will typically be deleting this folder when this project is done or at a stage we feel warrants removal of files.
We reserve the right to delete files at any time without notice that we feel are no longer necessary, even if the project is still active. Therefore please always keep copies of any necessary or important files elsewhere on your local computer hard drive other than the DropBox folder!
WHAT HAPPENS TO YOUR FILES?
Typically as a courtesy to our customers we’ll retain your DropBox files by moving them to another archive folder somewhere within our computer system for long term storage, but we’ll be removing any unnecessary files from the synchronized DropBox folder that we created for you so that we can make room for current projects within our DropBox account.
HOW DOES THIS AFFECT YOU?
Once we remove any files from your DropBox folder you’ll no longer have access to them through DropBox or within your DropBox folder, but as a continuing customer you will however, continue to have access to your DropBox folder for any files that are intended for use with current or upcoming projects. In other words, the DropBox folder remains active as a temporary collaboration folder for any current projects and files for our customers.
WHAT SHOULD YOU DO?
If you need to retain a copy of any files within your DropBox folder that are important to you and you have not already done so, please make any necessary copies of your DropBox files by copying them over to a LOCAL drive on your computer as soon as possible by dragging-and-dropping them to a folder on your computer other than the DropBox folder.
Although we typically will retain your files within another archive folder for long term storage, this is not guaranteed, so please keep your own copy of source files. Once we remove files from your DropBox folder you’ll no longer have access to them through DropBox or within your DropBox folder.

PAY BY INVOICE
By prior arrangement we can send you an electronic Invoice via email (using our online accounting service called Freshbooks).
Once you click on the Invoice link within the email you can print out the Invoice or make a payment.
Invoices can be paid electronically via Paypal or Credit Card by clicking on the link provided via email (electronic payments register immediately), or you can send us a check (please notify us if you intend to pay by check since it takes longer to process). Paying by Invoice requires a $100 minimum, and are not valid for recurring subscriptions unless paid annually.
NOTE: Our Paypal account and our Invoicing system is under MileHighMarketing, our parent company.
If your company uses Purchase Orders we can generate an Invoice for you from your Purchase Order, but they are not required.
All Invoices are due and payable upon receipt (we don’t offer extended terms).

Pay Securely
For credit card transactions we use a third party secure credit card payment gateway service as the credit card processor. All credit card processing and security measures are handled by our credit card payment gateway service. Our credit card payment gateway service is a “PCI-Certified Secure Gateway with Built-in Anti-Fraud“, which is the highest and most stringent security standard available for online purchases with a credit card. No credit card information is ever digitally stored by us. When purchases are made online we store company information such as Company Name, Contact Name, Address, Email Address, and Phone Number. Regarding credit card information we are only aware of the last 4 digits of the credit card, and the status of any transactions. For Add-on Services we can accept Paypal, Credit Card, or with prior arrangements we can send an electronic Invoice (invoicing handled on case-by-case basis depending on service and depending on client). In some cases Add-on Services are handled and billed by SiteSubscribe, and in some cases Add-on Services are handled and billed by MileHighMarketing, our parent company. PAYMENT TERMS
Managed WordPress Hosting Plans [hereafter referred to as Website Plan, Web Plan, "plan", or "subscription"] Once any available Trial period for a subscription based service is over the customer will be prompted to make a plan selection if they wish to continue service (e.g. Dedicated Plan, Gold Website Plan, etc.).
Initiation Of Service
Payment for the selected Website Plan shall be collected at the beginning of time of service, pre-paid for the month of service. Upon payment confirmation, subscription clients will be given service access with email notification containing account information (username, password, plan selection, and a hyperlink to the Admin Dashboard).
Month-To-Month
All Subscription Website Plans are month-to-month, with a 1 month duration recurring from the calendar date of the plan start date.
Auto-Renewal
Subscriptions are automatically renewed and customer is charged for a new subscription term at the end of the existing subscription term unless subscription is cancelled by the customer prior to renewal. Renewal billing shall be billed using existing customer payment information (if available).
CANCELLATION / REFUND POLICY
Subscriptions: You can cancel your paid plan at any time. No credit or refund will be issued for unused subscription periods or for website setup.
PRICE CHANGES
All pricing including Subscription or other Service pricing and specifications are subject to change without notice. However, we will make every attempt to contact customers by posting a message within all available methods typically including the Dashboard, this website blog, and in some cases via email as notification of any changes.
If a price change is made to a recurring subscription it will not affect any subscriptions that are currently in progress. All subscription terms are captured at the time of purchase and preserved for the life of the subscription.
Canceling then restarting a subscription for any reason (including non-payment) constitutes a reset to current pricing.
NON-PAYMENT
If payment is denied for any reason (non-payment) we will attempt to collect payment again within 3 days. If for any reason we are not able to collect payment we will make every effort to contact the customer before discontinuing service.
There is a grace period of 30 days for annual subscriptions, 15 days grace period for 3 month subscriptions, and formally 0 days grace period for month-to-month subscriptions (informally we are likely to extend the grace period for month-to-month subscriptions to a few days).
If payment is in arrears past the grace period we reserve the right to discontinue services without notice (disable the account – take down the website and other web services including email).
Non-payment for any site building or design services constitutes our ownership of all materials in our possession related to the non-payment.
DISCOUNTS
Discounts must be requested at time of placing order to be accepted. Wholesale discounts may be available via special arrangement with qualified Resellers.
